Names of different levels of survey activities, description of services, actions of landowners, and officers/employees engaged in providing services
1. Notice: Before commencement of land survey, empowered under section 144(1) of the Bengal Tenancy Act, 1950 and section 03 of the Bengal Survey Act, by the ...........officer .................sections 5, 7 of the Act. Giving notice. Before the start of the survey, extensive public relations including miking and newspaper advertisements were carried out. At this time, the land owners should mark the aisles/boundaries of their respective lands. All documents/documents related to ownership of land should be kept up-to-date.
2. Traverse: Traverse is the structure placed in the mouza to create a completely new design of a mouza. Then a new design of mouza was prepared through P70 seats. Traversing is not done in surveying the old design of any mouza i.e. blue-print seat. Travers are conducted by a group of survey workers headed by a surveyor.
3. Kistwar: At this level the Amindal measures the area per block of land and reflects it in the mauza design by drawing a new plan and completing the Kistwar or correcting the old design in the blue-print. This level of work is carried out by the administration under the supervision of a Deputy Assistant Settlement Officer (Kanungo).
4. Khanapuri: Amindal attends each dag plot of land drawn at the Kistwar level and gives the dag number of the land and verifies the owner's records, documents and possession and records the owner's name, address and other information in the khatian (Khanapuri). At this level, the landowners are responsible for presenting evidence of land ownership and occupation to the Amindal. This level is done by the Amindal under the supervision of a Deputy Assistant Settlement Officer (Kanungo).
5. Meaning: Meaning of land. At this level the khatian or parcha prepared by the Amindal is supplied (communicated) to the land owner, known as the field parcha. The date of distribution of pamphlets is communicated through notices/ circulation of notices in newspapers/ miking in the area. The land owners will check the correctness of the received papers and if any corrections or changes are necessary, they will submit it to the Amin by filling the specified (Dispute) form. A Sub-Assistant Settlement Officer (Kanungo) as a Holka Officer shall expeditiously settle such disputes by hearing the parties concerned.
6. Khanapuri and Bhanarat: When a Mauza is surveyed on a blue-print sheet through traverse and kistwar, the work of Khanapuri and Bhanarat levels described above is done together. Sardar Amin/Halka Officer or Kanungo/Cadastral Circle Officer.
7. Tasdiq or Estation : Tasdiq level work is carried out through extensive publicity. Tasdik level work is performed by a Kanungo or Revenue Officer Every purported khatian is verified by verifying all the documents and proofs related to the ownership of the land. Even at this level, the landowners can file a dispute if they think any correction of the plan and design is necessary and can take the opportunity to correct it by presenting appropriate evidence. Attested deed is considered as the primary legal document in land ownership. So this level of work is very important.
8. Draft publication (DP) and filing of objections: Thereafter, the land record prepared is kept open for public inspection for 30 days. A notification is also circulated from the camp office mentioning its duration. To collect the new number i.e. DP number in the Khatian by sorting the Khatian or Parcha descriptively according to the name of the land owners and the land owners have to attend the draft publication (DP) camp with their respective Pacharas. If anyone has any objection or claim regarding the khatian published in the DP, the government can file an objection as per rule 30 of the tenancy rules by filling the specified form with a court fee of 10 (ten) rupees. 9. Objection Hearing: Objection cases received during DP are disposed of by taking hearing on specified date, time and place by informing the concerned parties through notice. The parties may present their respective claims to the Objection Officer in person or through a nominated representative. The objection officer shall hear the parties, record his decision on the judgment case record and make necessary corrections in the khatian or record in the light of the decision. 10. Appellate Hearing: The aggrieved party can file an appeal under Rule 31 against the judgment of objection. The appeal should be filed along with the copy of the judgment of the respective objection case by submitting an application to the Settlement Officer along with the prescribed court fee and cartridge papers.
